"You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, one will be provided for you". The City hopes that you will never hear those words, but if you do, remember that the Public Defender is there to help.
Municipal Public Defenders perform the following functions:
- Render legal advice, counseling and representation to all eligible defendants in the Jersey City Municipal Court; in addition, Municipal Public Defenders shall represent eligible defendants charged with nonindictable offenses involving gambling in both the Superior Court of Hudson County and the Municipal Court of Jersey City.
- Appeal any conviction or sentence where an appeal is warranted in the opinion of the Municipal Public Defender.
- Represent all city employees (with the exception of full-time police officers) charged with work-connected, nonindictable offenses.
A person applying for representation by a Municipal Public Defender or court-approved counsel must pay an application fee (currently $200). These application fees are deposited in a dedicated fund administered by the Chief Financial Officer to be used exclusively to meet the costs incurred in providing the services of a Municipal Public Defender, including, when required, expert and lay investigation and testimony.
